ALEX CAR RENTAL – TERMS & CONDITIONS
1. Definitions
For the purpose of this Agreement:
- Company/Operator refers to Alex Car Rental.
- Hirer/Client refers to the person or organization renting the vehicle.
- Vehicle refers to the rented motor vehicle together with all accessories, tools, documents, tyres, spare wheel, keys, and equipment supplied by the Company.
- Rental Period refers to the period beginning when the Vehicle is collected and ending when it is returned and accepted by the Company.
2. Driver Eligibility
The Hirer and any authorized driver must:
- Be at least 23 years old (unless otherwise approved by the Company).
- Hold a valid driving licence recognized in Uganda.
- Carry an International Driving Permit where required by law.
- Present a valid passport or National ID before vehicle collection.
- Drive only while medically fit and not under the influence of alcohol, drugs, or any substance that may impair driving ability.
Only drivers approved by Alex Car Rental may operate the Vehicle.
3. Vehicle Use Restrictions
The Hirer agrees that neither they nor any authorized driver shall:
- Use the Vehicle to transport passengers for hire or reward unless authorized by Alex Car Rental.
- Use the Vehicle in any race, rally, competition, or speed test.
- Carry more passengers than the manufacturer’s seating capacity.
- Drive off designated roads or tracks, especially within National Parks.
- Permit any unauthorized person to drive the Vehicle.
- Sublet, lend, sell, or transfer possession of the Vehicle.
- Use the Vehicle for any unlawful purpose or criminal activity.
- Drive outside Uganda without prior written permission.
- Tow another vehicle without prior approval.
- Replace, modify, or remove any vehicle parts or accessories without written consent.
- Use the Vehicle in breach of any law of Uganda or any East African country.
4. Hirer’s Responsibilities
The Hirer shall:
- Drive carefully and responsibly at all times.
- Maintain proper engine oil, coolant, brake fluid, and battery levels.
- Ensure tyre pressures are maintained correctly.
- Lock the Vehicle whenever unattended.
- Keep the Vehicle clean and secure.
- Avoid tampering with the engine, brakes, suspension, transmission, or electrical systems.
- Immediately report any warning lights or mechanical faults to the Company.
- Pay for puncture repairs. Where a tyre cannot be repaired, replacement costs may be shared unless negligence caused the damage.
5. Operator’s Responsibilities
Alex Car Rental will:
- Supply a clean, safe, roadworthy vehicle.
- Ensure the Vehicle has valid Third-Party Insurance.
- Provide emergency support where reasonably possible.
- Arrange a replacement vehicle within approximately 24 hours where mechanical failure occurs through no fault of the Hirer.
6. Mechanical Breakdown & Accidents
If the Vehicle is involved in an accident, stolen, damaged, or breaks down:
- Notify Alex Car Rental immediately.
- Report the incident to the nearest Police Station.
- Obtain a Police Report.
- Do not authorize repairs without Company approval.
- Do not leave the accident scene until Police inspection has been completed unless personal safety requires otherwise.
If the breakdown is mechanical and not caused by negligence, Alex Car Rental will arrange a replacement vehicle. The Company covers fuel required to deliver the replacement vehicle, while the Hirer provides fuel for returning the disabled vehicle.
7. Insurance
The Vehicle is covered by Third-Party Motor Insurance as required by Ugandan law.
Insurance does not cover:
- Personal injury or life insurance.
- Medical expenses.
- Personal belongings.
- Driving under the influence of alcohol or drugs.
- Negligence.
- Reckless driving.
- Cigarette burns.
- Tyre punctures.
- Wheel or rim damage.
- Underbody damage.
- Off-road driving.
- Driving in restricted areas.
The Hirer is strongly advised to obtain comprehensive travel and personal insurance before travelling.
Failure to obtain a Police Report after an accident may result in the Hirer being fully responsible for all damages.
8. Security Deposit (Insurance Excess)
Before commencement of the rental, the Hirer shall pay a refundable security deposit.
- Saloon Cars & Small SUVs – USD 350
- Large SUVs & 4×4 Vehicles – USD 1,000
The deposit will be refunded after inspection of the Vehicle, less any deductions for damage, missing items, traffic fines, or unpaid charges.
9. Damage for Which the Hirer is Fully Responsible
The Hirer shall be fully liable for damages resulting from:
- Overspeeding.
- Driving under the influence of alcohol or drugs.
- Single-vehicle accidents.
- Vehicle rollovers.
- Underbody damage.
- Off-road driving.
- Careless or reckless driving.
- Driving in restricted areas.
- Incorrect or contaminated fuel.
- Failure to follow Company instructions.
Clients are advised to refuel only at TotalEnergies or Shell service stations.
10. Cross-Border Travel
Vehicles may not leave Uganda without prior written authorization.
Where approval is granted:
- The Hirer shall obtain valid COMESA Insurance.
- The Hirer is responsible for all border fees and documentation.
- The Vehicle remains subject to these Terms and Conditions throughout the rental period.
11. Driving Regulations
Unless collecting from or returning to the airport, the Vehicle should not be driven after 7:00 PM.
Within National Parks:
- Maximum speed is 40 km/h.
- Vehicles must remain on designated tracks.
- Wildlife has absolute right of way.
- Drivers must keep at least 100 metres from dangerous animals.
Any Uganda Wildlife Authority penalties shall be paid entirely by the Hirer.
Alex Car Rental shall not be responsible for damage caused by wildlife.
12. Fuel Policy
Vehicles are supplied and returned on a ¼ to ¼ fuel basis.
No refunds or credits shall be given for unused fuel.
13. Vehicle Return
The Hirer shall:
- Return the Vehicle on the agreed date and time.
- Return it to the agreed location.
- Return it in substantially the same condition as received, allowing for normal wear and tear.
Rental extensions require prior written approval and payment of additional rental charges.
14. Cancellation & Refund Policy
- Reservations cancelled at least 7 days before collection are eligible for a full refund of any refundable amounts, less any applicable processing fees.
- Cancellations made within 7 days may incur cancellation charges.
- No-shows may result in forfeiture of the booking deposit.
- No refund will be made for unused rental days once the rental has commenced unless agreed in writing.
15. Late Return
Vehicles returned late without approval may incur:
- Hourly late charges.
- Additional daily rental charges after 24 hours.
- Vehicle recovery costs where necessary.
16. Lost Keys & Accessories
The Hirer is responsible for replacement costs relating to:
- Keys.
- Remote controls.
- Registration documents.
- Number plates.
- GPS devices.
- Spare tyres.
- Vehicle tools.
- Safety equipment.
The Hirer shall also pay towing, locksmith, transportation, and associated costs.
17. Traffic Fines
The Hirer is solely responsible for:
- Speeding fines.
- Parking tickets.
- Toll violations.
- Police penalties.
- Uganda Wildlife Authority penalties.
- Any traffic offenses committed during the rental.
Where Alex Car Rental settles such penalties on behalf of the Hirer, the Hirer shall reimburse the Company together with any applicable administrative costs.
18. Vehicle Recovery
If the Vehicle becomes stuck, abandoned, submerged, immobilized, or requires recovery because of negligence or misuse, the Hirer shall pay all recovery, towing, accommodation, transportation, and repair costs.
19. Cleaning Charges
Vehicles should be returned reasonably clean.
Additional cleaning charges may apply where the Vehicle is returned with excessive mud, sand, stains, cigarette odor, animal hair, food spills, or excessive rubbish.
20. Personal Property
Alex Car Rental accepts no responsibility for personal belongings left in the Vehicle.
Lost property recovered by the Company will be retained for a reasonable period before disposal.
21. Privacy
The Hirer authorizes Alex Car Rental to collect and use personal information for:
- Rental administration.
- Insurance claims.
- Identity verification.
- Payment processing.
- Traffic offense administration.
- Compliance with legal obligations.
Personal information will only be disclosed where required by law or for legitimate business purposes.
22. Force Majeure
Alex Car Rental shall not be liable for delays or failure to perform its obligations due to circumstances beyond its reasonable control, including natural disasters, civil unrest, government restrictions, epidemics, road closures, strikes, terrorism, or war.
23. Governing Law
This Agreement shall be governed by the laws of the Republic of Uganda.
Any dispute shall first be resolved through negotiation. If unresolved, it shall be submitted to the competent courts of Uganda.
24. Entire Agreement
These Terms and Conditions, together with the Rental Agreement signed by the Hirer, constitute the complete agreement between Alex Car Rental and the Hirer.
No verbal statements or promises shall modify these Terms unless confirmed in writing by an authorized representative of Alex Car Rental.
25. Acceptance of Terms
By signing the Rental Agreement or taking possession of the Vehicle, the Hirer confirms that:
- They have read and understood these Terms and Conditions.
- They agree to comply with all provisions contained herein.
- They accept full responsibility for the Vehicle during the rental period.
- They agree to return the Vehicle in accordance with this Agreement.
